The Pentagon has opened a probe into “serious allegations of misconduct” against Sen. Mark Kelly that could result in “recall to active duty for court-martial proceedings,” just days after President Trump accused him of seditious behavior.
Kelly, a retired U.S. Navy captain, also has the standing to go to federal court if he is recalled to active duty to then be court martialed, said Rachel VanLandingham, a professor at Southwestern Law School and former Air Force lawyer.
President Donald Trump seized on the video last week and accused Kelly and the five other Democrats in it of sedition, “punishable by death.” He also reposted “hang them,” sparking widespread outrage that he was calling for their executions.
